ClashArcade is operated by Clash Arcade Inc., a Delaware corporation, with a mailing address at [MAILING_ADDRESS]. In these Terms, "ClashArcade," "we," "us," and "our" mean Clash Arcade Inc. "You" means you, the person using our services.
These Terms govern your use of the ClashArcade mobile application, our games, our website at clasharcade.com, and any related services (together, the "Services").
By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
ClashArcade is a free-to-play skill gaming platform. You play casual games, compete against other players on the basis of skill, and may win cash prizes.
You never pay us anything. There are no in-app purchases, no subscriptions, no deposits, and no wagers. Entry to every tournament is free. We fund prizes through advertising revenue.
Prizes are awarded on the basis of skill — your score relative to other players in your tournament. Prizes are not awarded by chance, drawing, or lottery.
To use the Services and to be eligible for prizes, you must:
We may require verification of your identity, age, or location at any time, including before paying out any prize. We may withhold a prize until verification is complete, and may void a prize if verification fails.

You are responsible for your account and for everything that happens under it. Keep your credentials secure.
One account per person. Creating or using more than one account is a violation of these Terms and grounds for forfeiture under Section 8.
You may delete your account at any time from within the app, or by contacting us at services@clasharcade.com. Deleting your account forfeits any unpaid prize balance.
Tournament entry is always free. Entries are granted in two ways:
Entries are not purchasable, have no cash value, are not transferable, cannot be sold or exchanged, and are not your property. Entries may expire. We may change the number of entries granted, the rate at which they replenish, and the conditions under which they are earned, at any time.
Entries are a license to participate. They are not currency and not a wager.
Tournaments are governed by these Terms together with our Official Contest Rules, which are incorporated into these Terms by reference. Where the two conflict on tournament mechanics, the Official Contest Rules control.
In summary: tournaments rank players by their best single score. Prizes are cash, paid to your ClashArcade wallet. Weekly leaderboard points are a separate, non-cash system.
Prize money in your wallet is not a bank deposit, is not insured, earns no interest, and is not transferable to another person. Cash out is subject to a minimum balance, identity verification, and the payout terms in the Official Contest Rules.
We may modify, suspend, or discontinue any tournament, prize structure, or the Services themselves at any time.
The Services are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or free of defects.
We are not responsible for, and will not replace entries, restore scores, extend deadlines, or award or adjust any prize because of:
A session interrupted on your side may be recorded as abandoned, with whatever score was submitted before the interruption, or with no score at all.
We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from any interruption, defect, delay, outage, or error in the Services, including lost prizes, lost entries, lost time, or lost opportunity.
Where a defect, outage, or error on our side affects a tournament, we may in our sole discretion:
We are not obligated to take any of these actions, and our decision as to which, if any, to take is final.
Prize amounts, prize pools, player counts, rankings, countdowns, and wallet balances shown in the app or on our website may be delayed, estimated, or incorrect. Displayed information does not constitute a promise or an offer. A prize is owed only when a tournament has been settled and the prize has been credited to your wallet by our systems. Where displayed information conflicts with our server records, our server records control.
We may correct any error at any time, including after a prize has been displayed or credited.
To the maximum extent permitted by law, our total liability to you in connection with any tournament is limited to the value of the prize you would have been owed in that tournament had the failure not occurred, and our total aggregate liability to you for all claims relating to the Services is limited to the greater of the total prizes credited to your wallet in the twelve months preceding the claim, or one hundred United States dollars (US$100).
Some jurisdictions do not allow certain limitations of liability. Where that is the case, these limits apply only to the extent permitted.
We may void any entry, score, ranking, prize, or wallet balance, suspend or terminate any account, and withhold or reverse any payout, where we determine that you have:
This section applies regardless of Section 7, and applies whether or not a prize has already been credited or paid.
Our determination is based on our own investigation and records, and our decision is final. We may report suspected fraud to third parties, including payment processors and law enforcement.
The Services are funded by advertising. You will see advertisements, and watching advertisements may grant entries. We are not responsible for the content of third-party advertisements or for anything you obtain from an advertiser.
The Services, including all games, software, artwork, and the ClashArcade name and logo, are owned by Clash Arcade Inc. and protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, reverse engineer, decompile, or create derivative works from any part of the Services.

You may stop using the Services and delete your account at any time.
We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. On termination for a violation under Section 8, any unpaid prize balance is forfeited.
We may update these Terms. When we do, we will change the "Last updated" date above, and where the change is material we will provide notice within the app. Continuing to use the Services after a change means you accept the updated Terms.
To the maximum extent permitted by law, the Services are provided without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. You and Clash Arcade Inc. agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
